EPA v. WHITEFIELD WWTP

Final Order No Penalty

Case summary

On November 14, 2018, Region 1 entered into a Clean Water Administrative Order on Consent (Order) with the Town of Whitefield, New Hampshire. The Town, owner of a wastewater treatment facility (WWTF) that discharges to the Johns River, has been unable to consistently comply with effluent limits contained in its NPDES permit. This Order supersedes a previous order issued in 2016 and establishes a revised schedule for Whitefield to complete the design and construction of all necessary WWTF improvements to come into compliance. New Hampshire has not been delegated the Clean Water Act program, but Region 1 worked in close coordination with the New Hampshire Department of Environmental Services in this matter.
