EPA v. N&D TRANSPORTATION
Case summary
On August 27, 2019, EPA Region 1 issued a Notice of Violation and Administrative Order (NOV/AO) to N&D Transportation Company, Inc. for alleged violations of CAA Sec. 112(r). N&D is a regional trucking and warehousing firm that handles and stores numerous chemicals reportable under EPCRA, some of which are also extremely hazardous substances covered by CAA 112(r) RMP and/or GDC requirements. Among EPA's findings are N&D's failure to file a risk management plan under 40 C.F.R. Part 68 and to conduct a process hazard analysis to ensure safe operation of the warehouse. The NOV/AO places N&D under an enforceable schedule to come into compliance with 112(r).
