EPA conducted the inspection, pursuant to CAA Sections 114(a)(1) and (2) and 208(a) to evaluate APlus Truck Sales, Inc.'s compliance with the defeat device prohibitions under CAA 203(a)(3)(B) and tampering prohibitions under CAA 203(a)(A). On August 28, 2019, EPA returned to APlus Trucks, Inc. to complete its inspection of electronic records that APlus Trucks, Inc. largely denied EPA access to during its initial inspection.
