EPA v. NU-BRITE CHEMICAL CO - C-2

Case summary

On July 17, 2019, EPA entered into an administrative order on consent (AOC) with AkzoNobel Coatings, Inc. (f/k/a Nu-Brite Chemical Co.), the owner and operator during the time of disposal, and with 10 First Street, LLC, current owner of the site for the performance of a removal action at the former Nu-Brite Chemical site in Taunton, Massachusetts and for payment of all EPAs past and future costs. The removal will address high levels PCBs in surface soils through excavating PCB-contaminated soils greater than or equal to 100 ppm, transporting them to a licensed off-site disposal facility, and constructing a TSCA-compliant cap. In addition, the owner respondent will provide access to the property and record deed restrictions to protect the TSCA-compliant cap. This AOC represents a 100% recovery.
