Case summary

On March 15, 2019, EPA Region 1 filed a CAFO settling claims for civil penalties against Campos Construction for violating TSCA by failing to comply with the Renovation, Repair and Painting Rule (�RRP Rule�) while renovating two rental properties in Portland, Maine. The settlement calls for the payment of a $4,860 penalty based upon the �Pilot Graduated Penalty Approach for TSCA RRP Rule and Abatement Rule Enforcement Actions.� To promote compliance, Campos Construction has also agreed to provide reports to EPA documenting its compliance with the RRP Rule during the six-month period between April 1, 2019 and September 30, 2019. The Maine Department of Environmental Protection conducted joint inspections with EPA and supported EPA in development of the enforcement case. Maine did not take delegation of the RRP Rule. This action will help to prevent young children from being exposed to the dangers of lead paint. On September 28, 2018, Region 1 issued an administrative Complaint against Campos Construction of Portland, Maine, for alleged violations of the Renovation, Repair and Painting (RRP) Rule under TSCA at two properties in Portland, ME. The Complaint alleges that Campos Construction: (1) failed to ensure that a certified renovator was performing or directing work as required by 40 C.F.R. 745.89(d)(1); (2) failed to cover the ground with impermeable material to collect paint debris as required by 40 C.F.R. 745.85(a)(2)(ii)(C); (3) failed to contain waste from both exterior and interior renovation activities as required by 40 C.F.R. 745.85(a)(4)(i) and 745.85(a)(2), respectively; (4) failed to clean the work area after completing the renovation in violation of 40 C.F.R. 745.85(a)(5); and (5) failed to provide an acknowledgement of the property owner's receipt of the Renovate Right pamphlet as required by 40 C.F.R. 745.86(a). The proposed penalty is $37,025. The Maine Department of Environmental Protection conducted joint inspections and supported EPA in development of the enforcement case. Maine did not take delegation of the RRP Rule. This action will help to prevent young children from being exposed to the dangers of lead paint.
