Case summary

4/22/21 The U.S. District Court for the Northern District of Georgia, entered a Consent Decree resolving alleged violations against Home Depot U.S.A., Inc. of the federal Lead Renovation, Repair and Painting (RRP) Rule. The Complaint, filed December 17, 2020, alleges that these violations occurred in connection with work performed by Home Depot?s contractors during home renovation projects across the country. The States of Massachusetts, Rhode Island, and Utah are authorized to implement the RRP Rule, and joined the United States in this action. Under the settlement, Home Depot will implement a comprehensive, corporate-wide program to ensure that the firms and contractors it hires to perform work are certified and trained to use lead-safe work practices to avoid creating lead dust and paint chips during home renovation activities. Home Depot will also pay a $20.75 million penalty, the highest civil penalty obtained to date for a settlement under the Toxic Substances Control Act. Of $20.75 million, $19,218,00 of the penalty will be paid to the United States, $732,000 will be paid to Massachusetts, $50,000 will be paid to the State of Rhode Island, and $750,000 will be paid to the State of Utah. 7/13/18 The Region referred to DOJ a case against The Home Depot At-Home Services, Inc. (THD AHS) for violations of the TSCA Renovation, Repair and Painting Rule (RRP Rule). Region 1 submitted this supplemental litigation referral in coordination with EPA Region 5, that submitted a referral against THD AHS in July of 2017. The Region 1 referral addresses violations that occurred at a residential property in Belgrade, Maine. The renovation resulting in violations took place while a two-year old child and his expectant mother were in the home.
