Case summary

On September 25, 2018, Region 1 filed Consent Agreement and Final Order to resolve civil admin. penalty claims against KX Technologies LLC (KXT LLC) of Connecticut and KX Technologies Pte. Ltd. (KXT Limited) of Singapore for alleged FIFRA violations. EPA initiated the case, in July 2018, by filing a complaint against KXT LLC and, in September 2018, amended the complaint to add KXT Limited as a Respondent. The violations allege: (1) that KXT LLC imported FIFRA-regulated water filtration devices in 2016 and 2017 without submitting required reports (called Notices of Arrival) before the products entered the U.S.; and (2) that KXT LLC and KXT Limited, for each of their respective facilities in West Haven and Singapore, failed to file FIFRA production reports for the reporting year 2016. Under the settlement, Respondents do not admit liability for the violations, but agree to pay a total penalty of $76,362 to resolve the alleged noncompliance. Under the CAFO terms, each Respondent also certifies that it has fully addressed the violations and is now operating in compliance with FIFRA and the FIFRA regulations. The reporting requirements at issue are enforced federally and not by the states under primacy or delegation.
