Case summary
On May 2, 2018, EPA entered into an administrative order on consent with the Town of Fairhaven, MA, in which the Town agreed to implement measures to meet its nitrogen limit in its NPDES permit. On September 27, 2017, Region 1 issued a NPDES Permit to the Town of Fairhaven. The Town filed a petition for review with the Environmental Appeals Board seeking review of the Permit?s effluent limits for nitrogen. This Order resolves that appeal. EPA implements the NPDES program in MA, but has worked in coordination with the MA Department of Environmental Protection in this matter.
