EPA v. ALVES FUELS INC

Final Order With Penalty

Case summary

On March 27, 2018, the Regional Judicial Officer approved an expedited settlement agreement with Alves Fuels, Inc. of Ludlow, Massachusetts resolving violations of Section 311(b)(3) of the Clean Water Act. In June 2017, a tanker truck rolled over, resulting in a 400-gallon spill of diesel fuel oil in Hinsdale, Massachusetts. Some of the oil entered a culvert, and an estimated 20 gallons flowed into Cady Brook. The company responded promptly to the spill and undertook cleanup responsibilities. The settlement requires a $2,200 penalty and ensures that the Respondent has cleaned up the spill and taken measures to prevent further spills. The SPCC program is a direct implementation program.
