Case summary
On September 28, 2018, Region 1 issued a Finding of Violation and Administrative Order on Consent (AOC) to Elliott Auto Supply Co., Inc. (d/b/a Splash Products) for violations of the General Duty Clause, Section 112(r), of the Clean Air Act at its Ayer, Massachusetts facility. In 2016, there was a 7,000-gallon methanol spill at the windshield wiper fluid manufacturing facility that prompted an EPA inspection. EPA inspected again in 2017 with the help of a flammable materials safety expert. Under the AOC, Splash Products will make improvements at the facility to bring it into compliance with the General Duty Clause. Work to be performed includes constructing a containment pond and containment pads for the tanker truck and railcar off-loading/storage areas. In addition, modifications will be made to the process for off-loading methanol to the storage railcars. The General Duty Clause is not delegated to the state, but EPA?s inspector contacted the state fire marshal when developing the case, and EPA provided copy of the AOC to the state upon signature
