Case summary
Administrative Order for Cost Recovery Agreement (122h) settlement with Orion Insurance Company for the Scovill Industrial Superfund Site in Waterbury, CT. The form of the settlement agreement is based upon the payment acceptance form provided by Orion. In consultation with EPA Headquarters and the Department of Justice ( DOJ ), the form has been modified to satisfy minimum standards for a Section 122(h) settlement agreement, but solely with respect to the amount of monies eventually received, thus making the agreement akin to a mere receipt of payment. Orion has informed EPA that it will receive approximately 58% of its claim based upon know information about the total available monies to satisfy all accepted claims. Payment will be deposited into EPA's special account for the Site to partially pay for EPA's ongoing and future remedial measures
