Case summary

On December 13, 2016, after pre-filing negotiations, Region 1 filed a consent agreement and final order (CAFO) to initiate and resolve a case against Hydro-Photon, Inc. (HPI) of Blue Hill, Maine. This case involves violations of FIFRA import reporting requirements, specifically, failure to file Notices of Arrival (NOAs) on multiple occasions in 2014 and 2015. The alleged violations relate to the importation of a pesticidal device known as the ?SteriPEN,? intended for use as a hand-held instrument to disinfect water by using UV light. Under the CAFO, HPI agreed to certify to current FIFRA compliance and pay a $42,284 penalty over 18 months based, in part, upon Respondent?s financial ability to pay. In April 2014, EPA had issued a Stop Sale, Use and Removal Order (SSURO) to HPI based on similar violations. Through the NOA process, EPA obtains vital data, before pesticide products arrive in the country, to inform decisions on whether or not the imports pose an unreasonable risk to human health or the environment.
