Case summary
On July 11, 2017, Region 1 settled an administrative penalty action against O.F. Mossberg & Sons, Inc. (Mossberg) alleging violations of Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA). Mossberg failed to timely submit a Toxic Release Inventory Form for copper processed and otherwise used at the company?s New Haven, Connecticut facility in 2012, 2013 and 2014. Failure to file TRI forms deprives the community of its right to know about releases and the presence of chemicals in the neighborhood. The CAFO requires Mossberg to pay a civil penalty of $43,419. Mossberg will also certify that it is currently operating in compliance with Section 313 of EPCRA and the regulations promulgated thereunder. This program is not delegated to the states.
