On January 3, 2017, Region 1 filed a consent agreement and final order (CAFO) resolving Clean Water Act violations against the J.F. White Contracting Co. and Massachusetts Department of Transportation for stormwater discharges into the Deerfield River not in compliance with the federal Construction General Permit. During an inspection in April 2016, the EPA inspector observed that the construction site had not been stabilized during the past winter months and that Respondents had failed to install proper controls at the storm drains.
