Case summary

On November 2, 2016, the Regional Judicial Officer signed off on an expedited settlement agreement with Champlain Oil Company, Inc. of South Burlington, Vermont resolving violations of Section 311(b)(3) of the Clean Water Act. On May 12, 2016, a gasoline spill occurred while a Champlain Oil Company, Inc. mobile fuel oil tanker truck was filling a 6,000 gallon above-ground tank at The Heritage Automotive Group, Inc. bulk oil storage facility located at 30 Green Mountain Drive, South Burlington, Vermont. Approximately 200 gallons of gasoline spilled to the pavement from a failed piping connection at the truck side of the transfer. As a result of the failed connection, gasoline spilled from the off-loading pad to a roadside trench which drains to North Brook. North Brook drains to Lake Champlain. Champlain Oil Company, Inc. and The Heritage Automotive Group, Inc. responded promptly to the spill and undertook cleanup responsibilities. Champlain Oil Company, Inc. has agreed to a $2,200 penalty.
