EPA v. MAINE WILD BLUEBERRY

Final Order No Penalty

Case summary

On September 29, 2017, EPA signed a Notice of Violation and Administrative Order on Consent (NOV/AOC) to The Maine Wild Blueberry Company. The company, a subsidiary of Oxford Frozen Foods, Inc., is a major supplier of frozen wild blueberries that uses anhydrous ammonia in its refrigeration system. An EPA inspection revealed that the company had violated many risk management program requirements of 40 C.F.R. Part 68. The Region anticipates to follow up the AOC with a penalty action. The AOC will improve chemical safety at this facility. Maine is not delegated to implement the RMP program
