Case summary
The owners of the RBF Frozen Desserts Site, H.P.D.I., LLC, have agreed to pay $40,000 to EPA in settlement of the Agency?s claim for past costs under CERCLA. Region 1 performed an emergency removal action at the Site in 2014 to address the potential for imminent release of anhydrous ammonia from the refrigeration system operated by tenant RBF Frozen Desserts, LLC. The agreement is subject to a thirty-day public comment period, which began on September 6, 2017. Once payment is made, under the terms of the agreement, EPA will release the CERCLA lien on the Site property.
