NATURE AND SIGNIFICANCE OF VIOLATIONS In an April 8, 2015 facility inspection, EPA identified that NLR was storing more PCB light ballasts than allowable under the deminimis threshold for commercial storers of PCB waste, that some of the ballasts did not have out-of-service dates, and that the facility lacked secondary containment. Based on that, EPA alleged the following violations by NLR of 40 C.F.R. Part 761: operation as a commercial storer of PCB waste without an EPA approval, per 40 C.F.R. 761.65(d); failure to have secondary containment, per 40 CFR 761.65(b)(1)(ii); and failure to mark items with an out-of-service date, per 40 C.F.R. 761.65(c)(8). The violations increase the likelihood of a release of PCBs into the environment. CAFO calls for compliance and a $23,00 penalty spread over 12 monthly payments.
