EPA v. EPPING NEW HAMPSHIRE

Case summary

On June 9, 2016, the Region issued a unilateral order (Order) to the Town of Epping, New Hampshire, which owns a wastewater treatment facility (WWTF) that discharges to the Lamprey River. The WWTF has an advanced membrane treatment system in addition to lagoons used for flow equalization as well as for sludge and septage disposal. The Town has been unable to meet the limits in its NPDES Permit for ammonia nitrogen, total phosphorus, and whole effluent toxicity due to lack of standard operation and maintenance procedures and lack of adequate staffing. In addition, the disposal of sludge and septage into the lagoons also contributes to the ongoing permit limit violations. This Order will require the Town to develop and implement standard operation and maintenance procedures, evaluate the role of the lagoons with respect to permit compliance, and hire additional staff. The Region worked in close coordination with the New Hampshire Department of Environmental Services in this matter.
