Case summary

On December 29, 2015, Region 1 settled an Administrative Penalty Complaint against B&B Petroleum, Inc. (B&B) for alleged violations of the CWA 311 Spill Prevention, Control and Countermeasure (SPCC) requirements at its Sterling Street Terminal in East Hartford, Connecticut. Under the terms of the settlement, B&B will pay a $15,000 penalty for having an inadequate and not fully implemented SPCC plan. Among other things, the facility did not have adequately sized secondary containment for the 1.18 million gallon oil storage tank or proper security. As a result of EPA?s inspection at the company, the company took immediate steps to correct the noted SPCC plan deficiencies, including the installation of a remote internal security camera and video surveillance monitoring system. Installation of this system was above and beyond what was necessary to comply with the regulations but ensures that the facility is more adequately protected and vandalism is deterred. The system installed by B&B has recording as well as remote monitoring capabilities and will provide around-the-clock protection to the facility. Though not an SEP, installation of this type of technology furthers the component of EPA?s Next Generation Compliance strategy to use and promote advanced emissions/pollutant detection technology so that regulated entities can more easily see pollutant discharges, environmental conditions, and noncompliance
