Case summary
On September 15, 2016, EPA referred to the Department of Justice for signature and lodging with the U.S. District Court for the District of Rhode Island a proposed Remedial Design/Remedial Action Consent Decree under CERCLA Sections 106 and 107 for Operable Unit Two (OU2) of the Peterson/Puritan, Inc. Superfund Site located in Cumberland and Lincoln, Rhode Island. The settlement set forth in the Consent Decree is a global settlement in that it resolves the claims of the United States, EPA, and the State of Rhode Island with respect to the liability of multiple classes of parties at OU2 of the Site, and will provide for the full cleanup of OU2, as well as Operation and Maintenance, required by the Record of Decision issued on September 8, 2015. The Remedial Design, Remedial Action, and Operation & Maintenance at OU2 are estimated to cost approximately $40.3 million plus approximately $6,045,000 in future oversight costs. This is the final remedy for the Site.
