Case summary
On October 26, 2015, EPA signed a cost recovery administrative settlement agreement under CERCLA Section 122(h)(1) at the RBF Frozen Desserts Superfund Site (the Site ) located in West Hartford, CT. RBF Frozen Desserts, LLC ( Settling Paty or RBF ) has agreed to pay for 100% of EPA's response costs at the Site in exchange for a covenant not to sue under Section 107(a) of CERCLA. The Settling Party is liable under CERCLA as the current operator of the Site. Following a required thirty day notice and comment period, EPA expects to make the Settlement Agreement effective. After an Effective Date is established, the Settling Party will have 45 days to make a one-time cash payment of $122,518.89 to the EPA Hazardous Substance Superfund .
