Case summary

On September 18, 2015, Region 1 settled an administrative penalty action against Suddekor LLC (Suddekor) alleging violations of Section 313 of EPCRA. Suddekor failed to complete and submit a Toxic Release Inventory Form for nitrate compounds processed at the company�s facility in East Longmeadow, Massachusetts in 2011, 2012, and 2013. The settlement requires Suddekor to pay a civil penalty of $42,569. Suddekor will also certify that it is currently operating in compliance with Section 313 of EPCRA and the regulations promulgated thereunder. This enforcement action is expected to encourage compliance by the regulated community with the reporting requirements of EPCRA and will ensure that the community is not deprived of its right to know about chemical releases that may affect public health and the environment. Additionally, the validity of health studies based on the TRI database will not be compromised, and comprehensive planning by federal, state and local authorities to clean up industrial pollution will be facilitated
