Case summary
The Order details seven violations of the conditions of the National Pollution Discharge Elimination System (?NPDES?) permit authorizing stormwater discharges from the City?s MS4 (the ?Permit?). In addition, the Order identifies four MS4 outfalls from which the City?s discharges untreated sewage and other pollutants ? the City does not have an NPDES permit authorizing these discharges. The Order provides a compliance schedule requiring that the City (1) prepare a revised MS4 outfall map that shows the locations of all of the City?s MS4 outfalls; (2) complete dry weather screening according to the schedule provided in the Permit; (3) complete wet weather monitoring according to the schedule provided in the Permit; and (4) perform investigations of the MS4 for illicit non-stormwater discharges according to the schedule provided in the Permit, including certain specified outfalls. Simultaneously, the Region is issuing a Request for Information to the City concerning other elements of its compliance with the Clean Water Act.
