Case summary
On September 18, 2015, Region 1 filed an administrative consent agreement and final order settling alleged violations by Buckeye Pipe Line of Section 311(j) of the Clean Water Act and the Oil Pollution Prevention Regulations at 40 C.F.R. Part 112 (Spill Prevention Control and Countermeasure plan requirements) promulgated thereunder. Based on EPA?s review of Buckeye Pipe Line?s 2011 SPCC plan, a March, 2013 inspection of its Ludlow facility, and subsequent correspondence with the company, EPA determined that the company?s SPCC plan was deficient in a number of respects. Under the terms of the settlement, the company agrees to pay a penalty of $78,780 for its past violations.
