Case summary
On February 5, 2015, Region 1 entered into an expedited settlement agreement with Worcester Sand and Gravel Company, Inc. of Shrewsbury, Massachusetts addressing violations of the Oil Pollution Prevention regulations at 40 C.F.R. Part 112, promulgated under Section 311(j) of the Clean Water Act. EPA?s Spill Prevention Control and Countermeasure (SPCC) inspection at the facility revealed that the facility did not have an SPCC plan. In particular, the facility failed to have sized secondary containment around some of the tanks at the facility. Significant spills and discharges were also observed at the facility which resulted in a loss of oil. Pursuant to the agreement, Worcester Sand and Gravel Company, Inc. will pay a $4,800 penalty.
