Case summary

On January 30, 2015, Region 1 filed a CWA administrative complaint against Pan Am Railways, Inc. and Boston and Maine Corporation for violations at their railway terminal located in East Deerfield, Massachusetts. Violations included failure to comply with the terms and conditions of the facility?s individual National Pollutant Discharge and Elimination System (NPDES) permit, discharging stormwater containing pollutants not in compliance with an NPDES permit and failure to fully implement an SPCC Plan in accordance with the Oil Pollution Prevention regulations found at 40 C.F.R. Part 112. The Region documented these violations during an inspection of the Site. The Region has worked in close coordination with the Massachusetts Department of Environmental Protection in this action.
