Case summary

On March 30, Region 1 and C.O. Jelliff Corporation (Jelliff) entered into a Finding of Violation and Administrative Order on Consent (AOC) for a violation at Jelliff?s facility in Fairfield, Connecticut under Section 112(r)(1) of the Clean Air Act, also referred to as the General Duty Clause. Jeliff produces wire at the facility by using ammonia and hydrogen, which are considered extremely hazardous substances under Section 112(r). The facility is located within 500 feet of multiple residences, public shops and businesses. Under the AOC, Jelliff is required to engage a third party to conduct a process hazard analysis to identify and assess potential hazards relating to the use, storage, and handling of anhydrous ammonia and hydrogen at the facility, submit recommendations made by the third party following its assessment of the potential hazards, and implement those recommendations according to a schedule. Jelliff has expressed interest in potentially achieving regulatory compliance by replacing its anhydrous ammonia and hydrogen system with an inherently safer technology.
