Case summary
The facility stores and processes more than 25,000 pounds of 1,1 difluoroethane, propane butane and isobutane and their mixtures - highly flammable gasses, some with dangerous combustion byproducts, all covered under the Risk Management Program. An inspection April 2013 found that the facility did not have safety proceedures in place including a Risk Management Plan, a reinspection six months later found that the facility still did not have all safety measures in place, and did not have all components of a Risk Management Plan completed. An Administrative order on Consent was issued in July 2014 directing the facility to complete and implement all aspects of the Risk Management Program. Failing to complete and implement a Risk Management program is a violation of the Clean Air Act Section 112(r) and the chemical release prevention regulations. The Consent Agreement and Final Order resolves Precise Packaging, LLC's liability for alleged violations of the chemical accident prevention provisions of Section 122(r)(7) of the Clean Air Act. The settlement requires payment of a $57,369 penalty and a SEP worth approximately $147,000. The SEP will provide Fall River emergency response personnel with appropriate emergency response equipment to respond to chemical emergencies.
