Jewett & Noonan Transportation, Inc. (the ?company?) is a transporter of goods and operates from facilities in West Bridgewater, Massachusetts and Gorham, Maine. On June 11, 2014, an oil tanker truck operated by Jewett & Noonan Transportation, Inc. overturned in a roundabout in Gorham, Maine. According to the State of Maine Crash Report, a car entered the roundabout and caused the tanker truck to swerve to avoid a collision with the car. No traffic citations were issued to the driver of the tanker truck. When the tanker truck rolled over it released approximately 8,190 gallons of oil. Approximately 1,461 gallons (34 barrels) of oil entered a stormwater catch basin. The stormwater catch basin and drainage system discharges into unnamed wetlands. The unnamed wetlands flow to Strout Brook which flows to Stroudwater River. Staining and stressed and dead vegetation were observed in the wetlands. The affected vegetation was limited to the flow path of the drainage through the wetlands system. Gorham police and fire, and State of Maine emergency response responded to the accident and Jewett & Noonan Transportation, Inc. hired Clean Harbors Environmental Services to clean-up the spill. The Agency deemed that the response and notification actions were adequate. EPA recommends sending a proposed ESA to the facility to resolve this matter as a CWA Class I administrative enforcement action. The proposed penalty is $6,400. The ESA penalties are consistent with the CWA 311 settlement penalty policy.
