Case summary

A Region 1Consent Agreement and Final Order (“CAFO”) will initiate and conclude an administrative penalty action under Section 16 of the Toxic Substances Control Act (“TSCA” or “Act”) against the Fairfield School District in Fairfield, Connecticut. Under the CAFO, Fairfield will address the unauthorized use of PCBs located in waterproofing felt inside the walls of the Riverfield School gymnasium. For an interim period Fairfield will maintain the PCBs isolated from exposure to building users and monitor for PCB releases. Within 10 years (with a possibility of an extension of up to five years upon a demonstration of necessity), Fairfield will remove and dispose of the PCB material. Fairfield will be assessed a penalty of $37,500. The penalty will be remitted in its entirety provided Fairfield complies will all conditions of the CAFO
