Case summary

On April 11, 2014, Region 1 filed a combined complaint and consent agreement and final order which both commenced and settled an action for civil penalties against East Coast Pros, LLC for failing to comply with lead-based paint renovation requirements during renovation work at the First Congregational Church on the Green in Norwalk, Connecticut. The company was in violation of TSCA, the Residential Lead-Based Paint Hazard Reduction Act, and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. The church facilities included a pre-school which had about 80 children below the age of six enrolled at the time the renovation was being performed. Continued enforcement of the lead paint RRP Rule ensures both that children are being protected from avoidable exposure to lead, as well as there being a “level playing field” for contractors following the health-protective work practices in the regulation. Because Respondent is a micro-business under EPA’s “Pilot RRP Penalty Program for Micro-Businesses” (May 3, 2012), the settlement calls for the payment of a $3,577 penalty
