Case summary
On March 3, 2014, Region 1 filed a Settlement Agreement (Agreement) resolving TSCA claims against Gerard Therrien for violations of the Renovation, Repair and Painting Rule, 40 C.F.R. Part 745, Subpart E, promulgated under TSCA. Gerard Therrien is an individual that maintains a small painting business in New Hampshire. This case was initiated as a pre-filing negotiation. Therefore, this Agreement simultaneously initiates and resolves EPAs claims that Mr. Therrien violated the above regulations. Subsequent to initiating the pre-filing negotiation, EPA determined, with concurrence by Headquarters, that due to the size of Mr. Therriens business, this matter should be resolved under EPAs May 3, 2012 Pilot RRP Penalty Program for Micro-Businesses. Pursuant to this settlement, Mr. Therrien will pay a penalty of $2,980.
