On April 17, 2014, EPA Region 1 filed a combined complaint, consent agreement and final order ( SuperCAFO )that simultaneously commenced and settlemd EPA's enforcement action against Envirocare Corporation for an alleged violation of Section 7 of FIFRA, 7 U.S.C. 136e. The SuperCAFO alleges that Envirocare failed to file timely an annual pesticide production report for calendar year 2012 in connection with its registered establishment in Wilmington, MA. Envirocare agreed to apy a civil penalty of $2,970 to resolve the violation. The requirement for registered establishments to report production and sales infomration helps EPA carry out compliance, risk assessment, and risk reduction functions important for protecting human health and the environment; without annual pesticided production reports, EPA cannot determine where and in what manner pesticides are being produced , sold, and distributed.
