Case summary
On March 20, 2014, EPA issued an Administrative Order (AO) to Old Dutch Mustard Co., Inc. d/b/a Pilgrim Foods (Pilgrim), located in Greenville, New Hampshire, to address violations of the 2008 Multi Sector General Permit (2008 MSGP) authorizing stormwater discharges. Pilgrim has not instituted control measures sufficient to prevent spills of vinegar and related materials from being discharged with stormwaters to a receiving stream. In addition, Pilgrim has failed to take corrective actions to address discharges that are causing or contributing to impairments of iron, aluminum, pH, and dissolved oxygen in the Souhegan River. The AO requires that Pilgrim immediately stop discharging all stormwater mixed with non-stormwater, other than those allowable non-stormwater discharges listed in the 2008 MSGP; submit to EPA for approval a corrective action plan to address non-stromwater discharges; and submit to EPA for approval a corrective action plan to address stormwater discharges causing or contributing to exceedances of water quality standards. An Information Request included with the AO requires the facility to provide EPA with additional information regarding operations and maintenance of its stormwater controls, as well as additional monitoring intended to better determine the composition of Pilgrims discharges.
