Case summary

On January 21, 2014, Region 1 issued a Consent Agreement and Final Order (CAFO) resolving a violation of the TSCA Renovation, Repair and Painting (RRP) Rule alleged against James J. Welch & Co., Inc. (JJ Welch). The complaint alleged that JJ Welch, a general contractor, failed to ensure that its subcontractor was in compliance with RRP Rule work practice standards during a window renovation project at a former school that was being converted to a community center in Kittery, Maine. The community center was intended to be the location of day care programs and was thus, a child-occupied facility subject to the RRP Rule. A separate complaint was issued against the subcontractor, NH Plate Glass Corp., for the underlying work practice violations. Pursuant to the agreement, JJ Welch will pay a penalty of $3,465, and will operate its business in compliance with the RRP Rule in the future.
