Case summary
On May 22, 2013, EPA issued an Administrative Order on Consent (AOC) to the Town of Newmarket, New Hampshire (Town) to address violations of the seasonal total nitrogen limit in the Towns NPDES permit (Permit) reissued on November 16, 2012 authorizing discharges from the Towns wastewater treatment plant. Third parties requested a hearing on the Permit, but the uncontested conditions of the Permit include a seasonal (from April 1 through October 31) monthly average limit of 8 mg/l for total nitrogen. The Town routinely discharges effluent from the WWTF Outfall 001 containing total nitrogen in excess of 8.0 mg/l. The AOC includes a schedule for developing and implementing controls for total nitrogen load to the Lamprey River and Great Bay Estuary from the Towns Treatment plant, its non-point sources and stormwater point sources.
