Case summary

On September 30, 2013, the Region entered into an Agreement with the Town of Stratford, Connecticut, to release a CERCLA Section 107(l) lien that the Region filed against the abandoned Raybestos Memorial Ballfield (“Ballfield”) at the Raymark Industries, Inc. Superfund Site, in Stratford, Connecticut (the “Ballfield”). In March of 2011, the Town filed a complaint to foreclose against the Ballfield for non-payment of real estate taxes. Although the Town intends to relocate its Department of Public Works onto the Ballfield, the Agreement provides for a release of EPA’s lien in exchange for a share of the proceeds if the Town sells the Ballfield at a later date. The Town alleged that its foreclosure action would have extinguished EPA’s lien.
