EPA v. MIDSTATE MEDICAL CENTER INC / FACTORY H

Final Order With Specified Cost Recovery

Case summary

On April 17, 2013, after a required 30-day public comment period had closed, EPA made effective an administrative settlement agreement for recovery of past costs at the Factory H Superfund Site in Meriden, Connecticut. The settlement requires a former Site owner and potentially responsible party, MidState Medical Center, Inc., to pay a portion of past costs incurred by EPA at the Site as a result of Fund-lead response activities, in 2007 and 2008, to address asbestos contamination. Specifically, the settlement requires MidState -a local non-profit medical services provider - to reimburse EPA for $100,000 in past costs incurred at the Site. No additional removal work is required by the agreement and MidState does not admit to any CERCLA liability thereunder.
