EPA v. BRIAN R SULLIVAN / WALTON & LONSBURY

Case summary

On March 18, 2013, the Region issued an Administrative Order to Compel Compliance with Information Request and Access to Documents at the Walton & Lonsbury Superfund Site in Attleboro, MA (the “Site”). The order was issued to Attorney Brian Sullivan. From 2010 to the present, EPA has performed a Time-Critical Removal at the Site. In September 2012, EPA completed the Hazardous Ranking System evaluation and proposed the Site onto the National Priorities List. From 1940 to 2007, Walton & Lonsbury, Inc. operated a chromium plating facility which utilized a number of chemicals and chemical compounds that were left as waste and discharged into the surrounding wetlands and a stream. In September 2011, EPA sent a Request for Information to Jeannette T. Gagnon c/o Brian R. Sullivan, Esq. requesting that Ms. Gagnon furnish certain information to EPA (“Gagnon Information Request”). In November 2011, EPA sent a Notice of Failure to Respond to CERCLA Request for Information to Ms. Gagnon c/o attorney Sullivan. From December 2011 to February 2012, EPA has made several telephone calls to attorney Sullivan requesting a response to the Gagnon Information Request. In March 2012, EPA issued an Administrative Order to Compel Compliance with Information Request and Access to Documents to Ms. Gagnon c/o attorney Sullivan. In November 2012, EPA issued a Request for Information to attorney Sullivan requesting certain information (“Sullivan Information Request”). On December 12, 2012, EPA issued a Warning Letter requesting that attorney Sullivan furnish certain information to EPA. Over the last sixteen months, EPA mailed letters and made several telephone calls to attorney Sullivan requesting responses to the Gagnon Information Request and to the Sullivan Information Request. To date, EPA has not received a response to either Information Request.
