Case summary
On August 22, 2012, Region 1 filed a CAFO that simultaneously initiated and settled an enforcement action against The TJX Companies, Inc. (TJX) for violations of EPCRA and the associated federal regulations at 40 C.F.R. Part 370. TJXs subsidiary, NBC Second Realty Corp., owns and/or operates a warehouse and distribution center located Worcester, Massachusetts that services TJXs retail operations. An EPA inspection at the warehouse revealed that TJX was storing lead and sulfuric acid (from batteries) in quantities above the applicable minimum threshold levels and had failed to file the required Tier II forms for these chemicals for calendar years 2007-2009. Under the terms of the CAFO, TJX will pay a penalty of $26,325 to resolve the alleged violations.
