Case summary

Region 1 signed an administrative order on consent (AOC) with Maritime International, Inc, Connecticut Freezers Inc., Bridge Terminal, Inc. and Maritime Terminal, Inc. (collectively, Maritime) to require safety improvements at three cold storage facilities located in New Bedford, Massachusetts and East Hartford, Connecticut. The facilities use ammonia, an extremely hazardous substance, in their refrigeration systems. After an ammonia release occurred at a related cold storage facility in New Haven, EPA issued a unilateral administrative order and reporting requirement to some of the same Respondents to address violations of Clean Air Act Section 112(r)’s General Duty Clause at the New Haven facility and to require process safety analyses at the New Bedford and East Hartford facilities. Maritime conducted the required process safety analyses and will make safety improvements to the facilities pursuant to this AOC, at a cost of approximately $160,000. These facilities are in Environmental Justice (EJ) areas. Maritime has shut down the New Haven facility, which is also in an EJ area. The AOC does not preclude further enforcement.
