Case summary
This is a Notice of Violation and Administrative Order for violations of the mechanical integrity provisions of the Clean Air Acts Risk Management Planning (RMP) requirements, found at 40 C.F.R. § 68.73 and/or documentation requirements of 40 C.F.R. § 68.200 . The company had a slow release of ammonia in October 2010 that was caused by faulty relief valves. The ammonia sensor that should have detected the leak was inoperable due to corrosion. EPA inspected the facility on June 16, 2011 and found some deficiencies in the implementation of the companys preventative maintenance plan. Maintenance was contracted out to a refrigeration maintenance company. The Administrative Order requires the company to certify compliance with 40 C.F.R. § 68.73.
