Case summary

Region 1 has entered into a CERCLA ability-to-pay settlement with the City of Middletown, Connecticut and RLO Properties, Inc. concerning the Omo Superfund Site in Middletown, Connecticut. The City was the former operator of the Site and RLO Properties is the current owner. Under the settlement, the City will pay $2.8 million and RLO Properties will provide access in order to settle EPA's claims under Sections 106 and 107 of CERCLA. The Region will use the settlement proceeds to perform a fund-lead removal action at the Site. Following a public comment period, the agreement became effective on August 20, 2012.
