EPA v. JEANNETTE GAGNON / WALTON & LONSBERRY

Case summary

EPA is currently performing a Time-Critical Removal at the Walton & Lonsbury Superfund Site (the “Site”) located at 78 North Avenue in Attleboro, Bristol County, Massachusetts. From 1940 to 2007, Walton & Lonsbury, Inc. operated a chromium plating facility at the Site. The chrome plating operations utilized a number of chemicals and chemical compounds were used, left as waste and discharged into the wetlands and a stream. This Administrative Order to Compel Compliance with an Information Request is issued to Jeannette T. Gagnon for failure to respond to the initial 104e request (September 28, 2011) and a subsequent Warning Letter (November 28, 2011). Over the period of the last six months, EPA mailed letters to Respondent and her attorney. EPA attorney DeCambre has made several telephone calls to Respondent (December 20, 2011, February 8, 2012, and February 15, 2012) requesting a response to the September 2011 Information Request. To date, EPA has not received a response to the Information Request. Raymond Gagnon was part owner of the facility property and part owner of Walton & Lonsbury. Mr. Gagnon died in 1987. Respondent, Jeannette T. Gagnon, was married to Raymond Gagnon and inherited assets from the Estate of Raymond Gagnon.
