Case summary

On May 22, 2012, the U.S. District Court for the District of Massachusetts entered a Consent Decree that includes cost recovery for EPA under CERCLA. The Decree provides for EPA recovery of $724,310 from NuStar TS, SGH Enterprises, formerly known as Samson Hydrocarbons, and W.R. Grace. The three entities are successors to the owner/operator of an aviation fuel pipeline at Massachusetts Military Reservation (“MMR”) which leaked in 1972. The contamination from the pipeline is being addressed by the U.S. Air Force in response actions pursuant to a CERCLA Federal Facilities Agreement with EPA.
