Case summary

In January 2011, the respondents shipped approximately 4,300 gallons of waste transformer oil for disposal from the former site of the English Station power plant in New Haven, CT. The waste oil was not identified by the respondents as containing PCBs. The disposal facility, which was not authorized to dispose of PCBs, tested the waste oil and identified it as containing PCBs. The waste oil was eventually shipped for disposal at an authorized PCB disposal facilty. The issue was reported to CT DEP which subsequently inspected the facility. Based on information from CT DEP, the respondents and other sources, Region 1 determined that ASNAT and Evergreen violated the PCB Regulations and Section 15 of TSCA by failing to properly complete the waste manifest for the 4,300 gallons of PCB-contaminated waste transformer oil and by storing PCB waste without notifying EPA of PCB waste activities and having an EPA identification number. In September 2012, the respondents agreed to pay a civil penalty of $20,000 (plus interest) in settlement of this matter.
