Case summary

On September 29, 2011, after prefiling negotiations, Region 1 filed a CAFO to both initiate and resolve a FIFRA administrative penalty case against AgION Technologies, Inc. of Wakefield, Massachusetts, SCIESSENT LLC, successor to AgION, and Sinanen Zeomic Co., Ltd., a Japanese firm that supplies FIFRA-registered pesticides. The violations, which arose out of Respondents’ distribution and sale of silver-ion antimicrobials, include misbranding, “substantially differing claims” relating to a silver-ion based hospital disinfectant, failing to file reports with EPA for pesticides imported into the U.S., and producing pesticides in an unregistered establishment, namely, the Sinanen plant in Nagoya, Japan. The Respondents will pay a penalty of $220,000.
