Case summary

EPA settled FIFRA administrative penalty actions against two Massachusetts companies for violating pesticide reporting requirements. Traveler’s Supply, Inc. (Traveler’s) of Chicopee failed to submit annual production reports for calendar years 2007 and 2009. The company will pay a penalty of $990. FCS-Chemsupply, Inc., d/b/a Chemstation-Boston (Chemstation) of Weymouth failed to submit annual production reports for calendar years 2007, 2008, and 2009. In exchange for a mitigation of the entire civil penalty amount to zero, Chemstation cancelled its establishment registration and has agreed not to produce any pesticides or pesticide devices or seek re-registration under FIFRA for at least five years. If Chemstation violates the certification agreement, the previously mitigated civil penalty of $9,720 will be reinstated and due with interest.
