Case summary
On March 11, 2011, Region 1 re-issued an administrative compliance order (Order) (Docket No. 11-008) to Germain Bourdeau and his company, Pleasant Acre Farms, LLC, which farm many parcels of land in Vermont and upstate New York. The violations addressed in the re-issued Order arise from Mr. Bourdeaus and/or Pleaseant Acre Farms, LLCs unpermitted discharges of dredged and fill material into approximately three (3.0) acres of freshwater wetlands at a farm in Swanton, Vermont. The re-issued Order supersedes the original Order issued in November 2010, and is being re-issued as a result of information that the case team obtained during an in-person meeting with Mr. Bourdeau after the original Order was issued. The re-issued Order allows Mr. Bourdeau and Pleasant Acre farms, LLC to apply to the Army Corps of Engineers (Corps) for an after-the-fact (ATF) permit to retain 0.9 acres of the 3.0 acres of altered wetlands. It also requires Mr. Bourdeau and Pleasant Acre Farms, LLC to comply with any permit issued by the Corps, including any required compensatory mitigation.
